Brian have you tried this http://www.lexar.com/software/ its called image rescue do a search you'll probably get it on a free trial, it will retrieve deleted photo's even if the card has been formated time and time again or partially overwritten. Unless your card has been destroyed in a fire you will get some data back. I Use this at work and can vouch for its effectiveness. Why not give it a go and settle the argument one way or other.
