Brian have you tried this http://www.lexar.com/software/ its called image rescue do a search you'll probably get it on a free trial, it will retrieve deleted photo's even if the card has been formated time and time again or partially overwritten. Unless your card has been destroyed in a fire you will get some data back. I Use this at work and can vouch for its effectiveness.

Why not give it a go and settle the argument one way or other.

I was one of the witness' that saw brain's immense catch of huge commons and the one he lost was even bigger...possibly a merseydive record....brain has caught huge fish wherever he has fished particularly impressive where his brace of 50lb mirrors from the shat al arab waterway which unfortunately due to coming under heavy fire from a bunch of mujhadeen lead by sylvester stallone were unable to be photographed and had to be slipped back a bit sharpish.
